I don't know all the details, but I think that even when Micky Mouse is no longer copyrighted, he might still be a trademark.

well i mean, there's a Disney Doom wad where you can kill Mickey Mouse in it.

I can not verify this but I read in some other place that Disney is required to shoot down every slight infringement on their IPs if they want to keep them. I do not know if this has always been the case but if it hasn't been, it is a slight victory I suppose - forcing them to spend money. :p

That is the case pretty much everywhere; that is why you will Bethesda suing developers using the words Scrolls or Prey or something similar in their title.
